Distance Sales Agreement

This Agreement has been drafted in accordance with the requirement to make contracts for sales made over the internet, and the terms are as follows:
ARTICLE 1 – SUBJECT
The subject of this agreement covers the rights and obligations of the parties regarding the sale and delivery of the product whose qualities and sale price are specified below, sold by the SELLER to the BUYER.

ARTICLE 2.2 – BUYER INFORMATION
The person who is a member of the shopping site artemisiklimlendirme.com as a customer.
The address and contact information used during registration shall be used.
ARTICLE 3 – PRODUCT INFORMATION SUBJECT TO THE CONTRACT
The type, quantity, brand/model, color, number, sale price, payment method of the goods/product/service consist of the information available at the time the order was finalized.
ARTICLE 4 – GENERAL PROVISIONS
4.1 – The BUYER declares that they have read and are informed about all preliminary information related to the basic characteristics, sale price, and payment method of the product(s) subject to the contract mentioned in Article 3, and has given the necessary confirmation in electronic form.
4.2 – The product(s) subject to the contract shall be delivered to the BUYER or the person/organization at the address indicated by the BUYER, within the period specified in the preliminary information, depending on the distance of the BUYER’s place of residence, provided that it does not exceed 30 days for each product. This period may be extended by a maximum of 10 days, provided that the BUYER is informed in advance.
4.3 – If the product(s) subject to the contract is to be delivered to a person/organization other than the BUYER, artemisiklimlendirme.com cannot be held responsible if the person/organization to be delivered does not accept the delivery.
4.4 – artemisiklimlendirme.com is responsible for delivering the product(s) subject to the contract in a sound, complete manner, in accordance with the qualifications specified in the order, and with any warranty certificates and user manuals, if available.
4.5 – For the delivery of the product(s) subject to the contract, it is obligatory for the signed copy of this agreement to be delivered to artemisiklimlendirme.com and for the price to be paid in the method preferred by the BUYER. If, for any reason, the product price is not paid or is canceled in the bank records, artemisiklimlendirme.com is deemed to be released from its obligation to deliver the product.
4.6 – If the BUYER’s credit card is used by unauthorized persons without any fault of the BUYER after the delivery of the product(s), and the relevant bank or financial institution does not pay the product price to artemisiklimlendirme.com, the BUYER is obliged to send the product(s) back to artemisiklimlendirme.com within 3 days, provided that the product(s) have been delivered to the BUYER. In such a case, the shipping costs belong to the BUYER.
4.7 – If artemisiklimlendirme.com cannot deliver the product(s) subject to the contract within the stipulated period due to force majeure or extraordinary circumstances such as adverse weather conditions that prevent transportation, interruption of transportation, it is obliged to inform the BUYER of the situation. In this case, the BUYER has the right to cancel the order, replace the product(s) subject to the contract with its equivalent if available, and/or postpone the delivery until the obstruction is removed. If the BUYER cancels the order, the amount paid will be refunded to them in cash within 10 days.
4.9 – This agreement will be valid with the acceptance of the BUYER by clicking “I have read and accept”.
ARTICLE 5 – RIGHT OF WITHDRAWAL
The BUYER has the right to withdraw from the contract within three (3) days from the delivery of the product to themselves or to the person/organization at the address indicated. To use the right of withdrawal, the BUYER must notify artemisiklimlendirme.com via fax, email, or phone within this period, and the product must not have been used in accordance with the relevant provisions of the contract. If this right is exercised, it is necessary to return the product to artemisiklimlendirme.com, along with a copy of the delivery receipt and the original invoice. The product price will be refunded to the BUYER within 10 days following the receipt of these documents. If the original invoice is not sent, VAT and other liabilities, if any, cannot be refunded. The return shipping cost for the product returned due to the right of withdrawal is covered by the SELLER.
The right of withdrawal cannot be exercised for products that are not suitable for return due to their nature, products that are disposable, reproducible software and programs, products that deteriorate rapidly or whose expiration date has passed. All kinds of software and programs, DVDs, VCDs, CDs, and cassettes, batteries, consumables (toner, cartridge, ribbon, etc.) and the right of withdrawal are subject to the condition that the packaging has not been opened, damaged, or the product has not been used.
If a product is returned after being received, it must be unopened, unless there is a defective part or malfunction for it to be returned.
In addition, the consumer cannot exercise the right of withdrawal for goods that are produced or customized upon special requests and demands of the consumer.
If the payment is made by credit card or a similar payment card, the consumer may request the cancellation of the payment transaction on the grounds that the card was used outside of their consent or unlawfully. In this case, the card issuer refunds the payment to the consumer within 10 days from the notification of the objection.
If the order is finalized, the BUYER shall be deemed to have accepted all terms of this contract.
The entire shopping process and after will be based entirely on the terms in this SALES AGREEMENT.
Return Conditions
The procedure you need to follow and the points you need to know if you want to return the product you ordered due to any problem after receiving it are as follows:
You must inform us of your return request and the problem with the product through the “Customer Services” section of our website or by sending an email to info@artemisiklimlendirme.com within seven business days following the day your order reaches you. We kindly ask you to return the product to artemisiklimlendirme.com within seven business days from the delivery date, following the direction email that will be sent to you. Unfortunately, we do not accept returns for notifications that exceed seven business days. When your request reaches us, it is evaluated by the authorized personnel, and an approval email is sent to you if your return is approved.
Make sure you return the product you wish to return with its original invoice, package undamaged, unused, and not damaged due to user error, including the order number and the correct address of artemisiklimlendirme.com. If the invoice for the product is corporate, you need to send it together with a ‘RETURN INVOICE’ issued by the institution in the form of ‘Product Unit Price + VAT’ without including the cargo share for the return process. Please note that we cannot complete corporate order returns if a ‘RETURN INVOICE’ is not issued.
The product’s box, packaging, standard accessories, if any, should be complete and undamaged within the package you returned to us.
Before approving your return, an inspection of the product is performed by the ‘artemisiklimlendirme.com – Returns Department’.
All return shipping costs within these conditions will be covered by you. However, if the product you wish to return is found to be defective, your return will be approved, and the shipping fee you paid for the return will be refunded to your account.
Special Conditions
Returns of products whose original packaging is damaged, opened, tried out, used, damaged due to usage, or without the original invoice are not accepted.
The return of the product is accepted when all standard accessories, packaging, and original invoices are returned undamaged and in their entirety. There is no return under the ‘Right of Withdrawal’ after seven days from delivery.
The customer is obliged to return the product in the condition it was received and to pay the commercial loss resulting from its use.
Our company does not accept responsibility for damages or destruction of products made of wood, MDF, particle board, etc., during transportation to the consumer.
If the service is completed, the BUYER shall be deemed to have accepted all the terms of this contract.
